Conditions of use
  1. Purchase of Access to Country Education Profiles (CEP) Online

    These Terms and Conditions apply to the purchase of access to and usage of the nominated Country Education Profiles (CEPs), as well as the usage of the online gateway, from this website. In using this web site to access the nominated online CEPs you agree to be bound by these terms and conditions. These Terms and Conditions must be read in conjunction with any other applicable terms and conditions governing the use of this website.

  2. Terminology
    In these Terms and Conditions:
    • the expressions “we”, “us” and “our” are a reference to the Commonwealth of Australia as represented by the Department of Education; and
    • the expressions “you” and “your” are:
      • if you are purchasing access to an online CEP on behalf of an organisation – a reference to the organisation, its employees and agents;
      • if you are purchasing access to an online CEP for your personal use – a reference to you.
    • the expression “users” of an organisation refers to employees of that organisation including contractors. It does not refer to members or the expression “users” of an organisation refers to employees of that organisation including contractors. It does not refer to members or membership of an organisation, or persons registered, affiliated or associated in some way with the organisation.

  3. CEP Access
    We will provide you with access to the nominated online CEPs once:
    • you agree to these Terms and Conditions;
    • you pay the specified fees for the nominated CEPs; and
    • we have processed your payment.

    Access to the CEPs will be through CEP Online unless otherwise notified by us. You will be granted access for the time specified in your chosen subscription (“the Subscription Period”) from the date of receipting of your payment. For offline payments, the access period is calculated from the date the order is placed.
    You accept that any information provided by us in CEP Online is general information and is not in the nature of advice. We derive our information from sources which we believe to be accurate and up-to-date as at the date of publication. We nevertheless reserve the right to update the information in CEP Online at any time. In addition we do not make warranties or representations that your access to the online CEPs will be uninterrupted, timely or secure.

  4. Security of Information

    Unfortunately no data transmission over the Internet can be guaranteed as totally secure. Whilst we strive to protect such information, we do not warrant and cannot ensure the security of any information which you transmit to us, before it reaches us. Accordingly any information which you transmit to us is transmitted at your own risk. Nevertheless once we receive your transmission we will take reasonable steps to preserve the security of such information. Payment online credit card details are encrypted by the Department of Education and then authorised by VeriSign.

  5. Payment

    The Fees for access to the nominated CEPs are calculated in accordance with the CEP Online Subscription pricing. Fees should be paid in full including the applicable Goods and Services Tax (GST). Payment must be made online by some credit cards (Visa or MasterCard).

  6. Passwords and System Administrator Responsibility

    In order to maintain the security of CEP Online, we require all persons and organisations granted access to CEP Online (‘users’) to use an individual password to gain access to the online CEPs.

    You must comply with the login and password procedures set out in the CEP Online website and these Terms and Conditions. You must keep your password safe and must not disclose your password to anyone else, not even colleagues within your organisation. You must notify us immediately if you have reason to believe that your password may have been disclosed to another person.

    At least one person within each registered organisation will perform the function of System Administrator. System Administrators have responsibility to add, delete or update details of other users or assign others to be a System Administrator from within their organisation. System Administrators must perform their responsibilities in accordance with these Terms and Conditions and any additional directions from us. System Administrators must not add as a user any person who is not an employee, contractor or agent of the organisation.

    Unauthorised use and/or allocation of passwords are a breach of the CEP Online Terms and Conditions and may lead to revocation of access for your organisation.

  7. Compliance with Law

    Chapter 7 of the Criminal Code (Commonwealth) provides for offences which attract substantial penalties, including theft of Commonwealth property and other property offences, obtaining property or financial advantage by deception, offences involving fraudulent conduct, bribery, forgery and falsification of documents.

    You acknowledge that you are aware that the giving of false or misleading information is a serious offence under the Criminal Code (Commonwealth).

  8. Permitted Use of CEP Online and Copyright

    Copyright in CEP Online is owned by us. You are granted a non-exclusive, non-transferable licence to view and print copies of the whole or any part of an online CEP to which you have purchased access for the Subscription Period.

    If the subscriber is an organisation, the System Administrator can add the number of users from their organisation as set out by their subscription (that is, 6 or less users or 7 or more users). Users of the organisation are permitted to access CEP Online, via the password and login processes detailed within CEP Online and these Terms and Conditions.

    You will nominate at least one individual within your organisation as the “System Administrator” for your access to the CEPs. The System Administrator will be responsible for granting and removing access to CEP Online for users of your organisation. Your System Administrator is required to remove access to any users who leave your organisation, or any users who have misused the subscription in breach of these Terms and Conditions.

    Except as expressly authorised by these Terms and Conditions, or the conditions prescribed under the Copyright Act 1968 (Commonwealth) and similar legislation which applies in your location, you may not, without our written permission:
    • reproduce, adapt, store, distribute, print, display, perform, publish or create derivative works from any part of CEP Online; or
    • commercialise any information obtained from CEP Online.

  9. Refunds

    Except as otherwise expressly set out in these Terms and Conditions, no refund will be provided for this service once your payment has been processed.

    No refunds will be provided to an organisation where the user numbers change. For example, if an organisation subscribes with 7 or more users, and the user number falls below 7 users before the Subscription Period expires, no refund or pro-rata refund will be provided. If an organisation subscribes with 6 or less users, and the user number increases to 7 or more users within the Subscription Period, in this circumstance, the organisation should subscribe to a 7 or more users subscription. No refund or pro-rata refund will be provided for a cancelled or unused portion of a subscription.

    No refunds will be provided to any unused portion of the 10 or 20 day access subscriptions.

  10. Suspension and Termination
    We may immediately terminate your access to CEP Online by written notice if:
    • you are in breach of your obligations under these Terms and Conditions;
    • you are in breach of our copyright in CEP Online; or
    • you provide false or misleading information to us.

    We may also immediately terminate your access to CEP Online by written notice for any other reason, in which case we will refund you, on a pro-rata basis, any part of the fees you paid for access to CEP Online which represent any unused portion of that access. If we have reason to believe that you have breached these Terms and Conditions, we may suspend your access to CEP Online while the matter is investigated.

  11. Disclaimer

    We do not accept responsibility for any loss or damage howsoever caused (including through negligence) which you may directly or indirectly suffer in connection with your use of CEP Online. You should make your own enquiries and seek independent advice from relevant industry professionals before acting or relying on any information contained in CEP Online.

    To the extent permitted by law, our liability for breach of any implied warranty or condition is hereby excluded. Where an implied term or condition cannot be excluded, our liability for breach of the implied warranty or condition is limited at our option to supply of CEP Online again or paying for its resupply.

    This disclaimer does not attempt or purport to exclude liability arising under statute if, and to the extent, such liability cannot be lawfully excluded.

  12. General

    These Terms and Conditions are governed by the laws in force in the Australian Capital Territory. You agree to submit to the exclusive jurisdiction of the courts of that jurisdiction.

    We may vary these Terms and Conditions at any time during the Subscription Period by written notice to you. The written notice may be by e-mail and will contain the date of effect of the variation. If you do not accept the Terms and Conditions as varied you may cancel your subscription prior to the date of effect of the variation by written notice to us. If you cancel your subscription as a result of a variation we will refund you on a pro-rata basis, any part of the fees you paid for access to CEP Online which represent any unused portion of that access.

    If we waive any rights available to us under these Terms and Conditions on one occasion, that does not mean that those rights will be automatically waived on any other occasion.
